Privacy Policy
Last updated: September 25, 2026
This Privacy Policy explains how Merrill Giant, LLC, doing business as Better Media and Sell Better (collectively, "Sell Better," "we," "us," or "our"), collects, uses, and discloses information about you when you use our websites, including sellbetter.xyz; our live shows, events, podcasts, newsletters, courses, and other online products and services (collectively, the "Services"); or when you otherwise interact with us, including when we contact you about business opportunities.
Our Services are intended for business professionals. This Privacy Policy does not apply to information we process on behalf of sponsors or other business customers under a separate agreement, or to third-party websites and services that we link to.
We may change this Privacy Policy from time to time. If we make changes, we will revise the "Last updated" date above and, where the changes are material, we will provide additional notice, such as a notice on our website or by email. We encourage you to review this Privacy Policy periodically.
Information We Collect
Information You Provide to Us
We collect information you provide directly to us, for example when you subscribe to our newsletter, register for a show or event, download a resource, create an account, purchase a course or other product, submit a testimonial, participate in a live show, chat with us on our website, or contact us. This information may include your name, email address, phone number, company name, job title, industry, LinkedIn or other professional profile, payment information, and any other information you choose to provide, such as questions or comments you submit during a show.
Payments are processed by third-party payment processors, such as QuickBooks Payments (Intuit) for invoices and Teachable for online course purchases. These processors collect and process your payment information under their own privacy policies. When you purchase or access a course through Teachable, Teachable also collects account and usage information to operate the course platform. We do not store full payment card numbers on our systems.
Information We Collect Automatically
When you access or use our Services, we and our partners automatically collect information, including:
- Log and usage information, such as your browser type and language, access times, pages viewed, links clicked, time spent on pages, your IP address, and the website you visited before ours.
- Device information, such as your device type, operating system, and browser settings.
- Approximate location, derived from your IP address.
- Email engagement information, such as whether you opened our emails or clicked links in them, collected through pixels and tracked links in our emails.
- Information collected by cookies and similar technologies, as described in "Cookies, Analytics, and Advertising Technologies" and "Visitor Identification and Online Tracking" below.
Information We Collect From Other Sources
We obtain information about you from third parties and publicly available sources and may combine it with information we collect through our Services. These sources include business contact and sales-intelligence data providers; website visitor identification and identity-resolution partners; sponsors and co-marketing partners; event and webinar platforms; social media platforms and professional networking sites (for example, when you interact with our content on LinkedIn or YouTube); and publicly available sources such as company websites. This information may include your name, business email address, phone number, employer, job title, industry, and professional profile information.
Visitor Identification and Online Tracking
We work with third-party data partners, such as identity-resolution and website visitor identification providers, that use cookies, pixels, and similar technologies on our websites to collect information about your visit. This may include pages viewed, time on site, device and browser information, and IP address. These partners may associate that activity with other information they or others hold about you, such as your name, email address, postal address, employer, or job title, and share the results with us.
We may use this information to send you marketing communications by email or mail, to understand which organizations are interested in our Services, and to measure and improve our marketing. These partners may also use this information for their own purposes, as described in their own privacy policies.
Depending on where you live, this activity may be considered a "sale" or "sharing" of personal information, or "targeted advertising," under applicable law. You can opt out as described in "Your Choices About Tracking" below. You can also opt out directly with one of our current partners at https://app.retention.com/optout.
Show Recordings and Audience Participation
Our live shows, events, and podcasts are recorded and may be published on our websites, podcast feeds, YouTube, LinkedIn, and other channels. If you participate, for example by joining on camera or audio, asking a question, or posting in the chat, your name, image, voice, username, and comments may be captured in the recording and made publicly available. If you do not want to appear in a recording, please keep your camera and microphone off and avoid including personal information in chat or questions.
If you submit a testimonial or review, we may publish it along with your name, title, company, and photo, as you provided them, in our marketing materials.
How We Use Information
We use information about you to:
- Provide, maintain, and improve our Services, including our shows, events, podcasts, newsletters, and courses;
- Register you for shows and events, deliver access links, and send related confirmations and reminders;
- Process transactions and send receipts and related information;
- Respond to your comments, questions, and requests, and provide customer support;
- Send you technical notices, security alerts, and administrative messages;
- Send you newsletters and marketing communications about our Services, events, and offers, and those of our sponsors and partners;
- Identify and contact businesses and professionals who may be interested in sponsoring, advertising with, or partnering with Sell Better, and conduct other business-development outreach;
- Record, edit, and publish our shows, events, and podcasts;
- Monitor and analyze trends, usage, and engagement with our Services and communications;
- Personalize our content and marketing, and measure the effectiveness of our advertising;
- Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity;
- Comply with our legal obligations and enforce our terms; and
- Carry out any other purpose described to you when the information was collected.
We use service providers that offer artificial intelligence tools, for example to transcribe or summarize show recordings or to help draft content. We do not permit these providers to use your personal information to train their own models.
How We Share Information
With Sponsors
Many of our shows, events, and resources are sponsored. When you register for a sponsored show or event, or download sponsored content, we share your registration information with the sponsor or sponsors identified on the registration page. This may include your name, email address, company, job title, and whether you attended. Sponsors may use this information to contact you about their products and services. Each sponsor's use of your information is governed by that sponsor's own privacy policy, not this one.
With Others
We may also share information about you:
- With vendors, consultants, and other service providers that need access to it to perform work on our behalf, such as hosting, email delivery, event and webinar platforms, payment processing, analytics, and customer support;
- With data partners and advertising partners as described in "Visitor Identification and Online Tracking" and "Cookies, Analytics, and Advertising Technologies";
- Publicly, when you participate in a recorded show or submit a testimonial, as described in "Show Recordings and Audience Participation";
- In response to legal process or a request for information if we believe disclosure is required or permitted by applicable law;
- To investigate or remedy potential violations of our terms or policies, or to protect the rights, property, and safety of Sell Better, our users, or others;
- In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business; and
- With your consent or at your direction.
We may also share aggregated or de-identified information that cannot reasonably be used to identify you.
Cookies, Analytics, and Advertising Technologies
We and our partners use cookies, pixels (also called web beacons), tags, and similar technologies to operate our websites, remember your preferences, understand how our Services are used, measure the effectiveness of our marketing, and deliver advertising on other websites and platforms. Some of these technologies are placed by third parties, which may collect information about your activity on our websites and across other websites over time.
We group these technologies into the following categories:
Cookie Schedule
A current list of the specific cookies and similar technologies we use, including the provider, purpose, and duration of each, is available in our Cookie Schedule at https://sellbetter.xyz/cookies (the "Cookie Schedule"), which is incorporated into this Privacy Policy by reference. Because the technologies we use change from time to time, we update the Cookie Schedule periodically, and each version shows the date it was last updated. Updates to the Cookie Schedule do not by themselves change the "Last updated" date of this Privacy Policy. If we begin using a technology that involves a materially different use or disclosure of your personal information than this Privacy Policy describes, we will update this Privacy Policy as well.
Most web browsers accept cookies by default. You can usually set your browser to remove or reject cookies, although doing so may affect how our websites work.
Your Choices About Tracking
Our websites use third-party tracking technologies that may collect information about your online activities over time and across different websites, as described above. Because there is no common industry standard for interpreting browser "Do Not Track" signals, we do not currently respond to them.
Where required by applicable law, we treat a Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of your personal information, and of targeted advertising, for the browser or device sending it. You may also opt out by:
- Using any cookie consent or preferences banner presented to you on our websites or landing pages;
- Emailing us at privacy@bettermedia.xyz;
- Adjusting your browser settings to block or delete cookies; or
- Using the opt-out tools offered by our partners, such as https://app.retention.com/optout for visitor identification and https://tools.google.com/dlpage/gaoptout for Google Analytics.
Opting out of tracking does not opt you out of email. See "Email Communications and Anti-Spam Policy" below.
Email Communications and Anti-Spam Policy
Sell Better sends commercial email in accordance with the CAN-SPAM Act and other applicable laws. We send two general types of commercial email:
- Audience communications. We send newsletters, show and event announcements, and product offers to individuals who have subscribed to our Services, registered for one of our shows or events, downloaded one of our resources, purchased a product from us, visited our websites, or otherwise interacted with us.
- Business outreach. Our sales team may send email to business professionals whose contact information we obtained from business data providers, public sources, or professional networks, to introduce sponsorship, advertising, and partnership opportunities that we reasonably believe are relevant to their role or organization.
Our email may be sent from sellbetter.xyz, bettermedia.xyz, or other domains that we own or operate, and may be sent on our behalf by service providers. Regardless of the sending domain, our commercial email will not use false or misleading header information or deceptive subject lines, and will provide a way to opt out of future commercial email from us.
We process opt-out requests promptly, and in any event within ten (10) business days. An opt-out from any Sell Better commercial email will be applied to all of our commercial email, including business outreach sent from any of our domains. You may also opt out at any time by emailing privacy@bettermedia.xyz or writing to us at PO Box 19, Yarmouth, ME 04096. Where the law of your location requires your prior consent to receive commercial email, we will obtain it.
Opting out of commercial email will not stop transactional or administrative messages related to Services you have requested, such as show access links, registration confirmations, purchase receipts, or account notices.
Sponsor communications. If you register for a sponsored show or event, or download sponsored content, and we share your information with that sponsor as described in "How We Share Information," the sponsor may contact you directly. Those messages are sent by the sponsor under its own privacy policy, and opting out of Sell Better email does not remove you from a sponsor's list; please use the opt-out in the sponsor's message.
If you believe you have received an email from us in error, please contact us at privacy@bettermedia.xyz.
Text messages. If you provide your mobile number and agree to receive text messages from us, we may send you show reminders and other messages. Message frequency varies, and message and data rates may apply. Consent to receive text messages is not a condition of any purchase. Reply STOP to opt out at any time, or HELP for help.
U.S. State Privacy Rights
This section applies to residents of California and other U.S. states with comprehensive privacy laws, to the extent those laws apply to us and to you. It supplements the rest of this Privacy Policy.
Categories of Personal Information
In the past 12 months, we have collected the following categories of personal information, from the sources described in "Information We Collect." We use them for the purposes described in "How We Use Information."
We do not collect sensitive personal information for the purpose of inferring characteristics about you. See "Children" below for our practices regarding minors. We retain each category for the periods described in "Retention" below.
Your Rights
Depending on your state of residence, you may have the right to:
- Know what personal information we have collected about you, and access a copy of it;
- Correct inaccurate personal information;
- Delete personal information we have collected from you;
- Opt out of the sale or sharing of your personal information, and of its use for targeted advertising; and
- Not receive discriminatory treatment for exercising these rights.
To opt out of sales, sharing, and targeted advertising, email privacy@bettermedia.xyz with the subject line "Do Not Sell or Share," or enable Global Privacy Control in your browser. To exercise your other rights, see "Your Rights and How to Exercise Them" below. If we deny your request, you may appeal by replying to our decision or emailing privacy@bettermedia.xyz with the subject line "Privacy Request Appeal."
California "Shine the Light." California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes by contacting us as described in "Contact Us."
EEA, UK, and Swiss Users
Legal Bases for Processing
If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, we collect and use your personal information only where we have a legal basis to do so. These bases are:
- Contract: to provide Services you request, such as show registration or a course purchase;
- Legitimate interests: to operate and improve our Services, publish our shows, communicate with business contacts, conduct business-development outreach, and prevent fraud, where those interests are not overridden by your rights;
- Consent: for marketing email where the law requires consent, and for non-essential cookies and tracking technologies; and
- Legal obligation: to comply with applicable laws.
Where we rely on consent, you may withdraw it at any time. Withdrawing consent does not affect processing that took place before withdrawal.
International Transfers
Sell Better is based in the United States, and we and our service providers process personal information in the United States and other countries whose data protection laws may differ from those of your country. Where we transfer personal information from the EEA, the UK, or Switzerland, we rely on an appropriate transfer mechanism. These include the European Commission's Standard Contractual Clauses (and the UK and Swiss equivalents), or the recipient's certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions.
Your Rights and How to Exercise Them
Depending on where you are located, you may have the right to access, correct, delete, or receive a copy of your personal information; to restrict or object to our processing of it; to withdraw consent; and to opt out of marketing, sales, sharing, and targeted advertising.
To exercise these rights, email privacy@bettermedia.xyz or write to us at the address in "Contact Us." We will verify your request by matching the information you provide against the information we hold, and we may ask for additional information to do so. You may use an authorized agent to submit a request on your behalf if you give the agent signed permission. We will respond within the time required by applicable law. Please do not include sensitive personal information in your request.
If you are in the EEA, the UK, or Switzerland, you also have the right to lodge a complaint with your local data protection authority. We would appreciate the chance to address your concern first, so please contact us.
To update your account information or request that we close your account, please email privacy@bettermedia.xyz. Because our Services run on more than one platform, please tell us which Services you use (for example, a course, the newsletter, or event registration) so that we can process your request across all of them.
Security
We maintain administrative, technical, and organizational measures designed to protect your information against unauthorized access, loss, alteration, and misuse, appropriate to the risk of the processing. Access is limited to personnel and service providers who need it to perform their duties. No data transmission or storage system is completely secure, however. If you believe your interaction with us is no longer secure, please contact us immediately at privacy@bettermedia.xyz.
Retention
We keep personal information for as long as necessary for the purposes described in this Privacy Policy. When deciding how long to keep information, we consider how long we need it to provide the Services you requested; whether you remain an active subscriber, customer, or business contact; our legal, tax, and accounting obligations; and the need to resolve disputes and enforce our agreements. When we opt you out of email, we keep your email address on a suppression list so that we can honor your request. Show recordings may remain published indefinitely.
Children
Our Services are intended for business professionals and are not directed to individuals under 18. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If we learn that we have collected personal information from a child under 13, or from anyone under 18 in a way that is inconsistent with this Privacy Policy, we will delete it. If you believe a child has provided us with personal information, please contact us at privacy@bettermedia.xyz.
Links and Third-Party Services
Our Services may link to or integrate with third-party websites and services, including sponsor websites, podcast and video platforms, and deal room tools. These third parties operate independently and have their own privacy policies. We are not responsible for their content or privacy practices, and we encourage you to review their policies.
